Please read these Terms of Service ("Terms") carefully before using the Buena Health website, booking system, or any services we offer. By accessing or using our services, you agree to be bound by these Terms.

1. About Buena Health

Buena Health ("we," "us," or "our") is a wellness and aesthetics provider offering in-person skin, hair, and weight-loss services, as well as a telehealth program for prescription peptide therapies. Our telehealth program is operated in partnership with AsherMed, a licensed telehealth medical provider, which handles all prescribing, clinical oversight, and dosage decisions for peptide services.

2. Telehealth Services & AsherMed Partnership

Buena Health coordinates access to telehealth-based peptide programs on behalf of AsherMed. By enrolling in any peptide program:
You understand that Buena Health does not prescribe medications. All clinical decisions, prescriptions, and treatment approvals are made solely by licensed providers at AsherMed.
You will complete a medical intake form hosted and reviewed by AsherMed prior to receiving any prescription product.
You consent to share relevant health information with AsherMed for the purpose of clinical evaluation.
Approval is not guaranteed. If AsherMed determines that a peptide program is not appropriate for you, your payment will be refunded in full.

3. Payment & Billing

By submitting your payment information:
You authorize Buena Health to charge the amount displayed at checkout to your provided payment method.
For peptide Rx programs, your card is charged at the time of order. If your prescription is not approved by AsherMed, you will receive a full refund within 5–10 business days.
For in-person services, payment is collected at time of booking to hold your appointment.
All payment information is encrypted and processed securely via Boulevard. We do not store raw card numbers on our servers.

4. Refund Policy

Peptide programs (prescription not approved): Full refund within 5–10 business days.
Peptide programs (no intake form submitted within 48 hours): We will follow up with you. Failure to complete intake after repeated contact may result in forfeiture of order.
In-person services (cancelled 24+ hours in advance): Full refund or credit.
In-person services (cancelled less than 24 hours / no-show): Non-refundable.
All refund requests must be submitted to hola@buenahealth.com.

5. Not a Substitute for Emergency Care

Our services β€” including telehealth consultations through our partnership with AsherMed β€” are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

6. Health Information & HIPAA

Any health information you provide is handled in accordance with our Privacy Policy and applicable federal and state health privacy laws, including HIPAA. We will not sell your health information to third parties. Information shared with AsherMed for clinical evaluation purposes is subject to AsherMed's own privacy practices.

7. User Eligibility

By using our services you represent that:
You are at least 18 years of age.
The information you provide is accurate and complete.
You are booking services for yourself or for someone for whom you are a legally authorized representative.

8. Limitation of Liability

To the fullest extent permitted by law, Buena Health shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including any adverse reactions to treatments or products prescribed by AsherMed. Our total liability to you shall not exceed the amount you paid for the service in question.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in California.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Continued use of our services after changes constitutes your acceptance of the revised Terms.
